Welcome to Growflyer! These terms and conditions govern your access to and use of Growflyer's Software as a Service (SaaS) platform, accessible at https://growflyer.com/. By using our services, you agree to comply with and be bound by these terms and conditions. If you do not agree to these terms, please refrain from using our services.
Eligibility: By using our services, you affirm that you are at least 15 years old to enter into a binding contract.
Account Responsibility: You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.
Lawful Use: You agree to use our services only for lawful purposes and in compliance with all applicable laws and regulations.
When creating an account with us, you must ensure that all provided information is accurate, complete, and up-to-date at all times. Failing to do so constitutes a violation of these Terms, which may lead to the immediate termination of your account on our Service.
Safeguarding your password used to access the Service is your responsibility. Any activities or actions undertaken using your password, whether within our Service or on a third-party platform, are your sole responsibility.
You agree not to disclose your password to any third party. Notify us promptly upon becoming aware of any security breach or unauthorized use of your account.
Using a username that belongs to another person or entity, isn't lawfully available for use, infringes on any third-party rights, or is offensive, vulgar, or obscene is prohibited
Growflyer may, at its sole discretion, offer a Subscription with a free plan ("Free Plan") for an indefinite period.
You may be required to sign up for the Free Plan by providing certain information, which may or may not include billing details.
For users who provide billing information upon signing up for the Free Plan, no charges will be applied by Growflyer during the Free Plan period. If the Free Plan does not have an expiry date, you will not incur charges as long as you remain on the Free Plan.
Growflyer reserves the right, without prior notice, to (i) modify the terms and conditions of the Free Plan, or (ii) discontinue the Free Plan
Certain aspects of the Service are offered through subscriptions ("Subscriptions"). You will be charged in advance on a recurring basis, following a specific timeframe ("Billing Cycle"). The billing cycles are typically set as monthly or annually, based on the chosen subscription plan.
Your Subscription will automatically renew at the end of each Billing Cycle unless you opt to cancel it or if Growflyer discontinues it. To stop the renewal, you can either manage it via your online account settings or get in touch with Growflyer's customer support team.
For the processing of Subscription payments, a valid payment method such as a credit or debit card is necessary. You're responsible for providing accurate billing information, including your full name, address, contact details, and valid payment method. By providing this payment information, you authorize Growflyer to charge all incurred Subscription fees to the specified payment method.
In the event of a failure in automatic billing, Growflyer will generate an electronic invoice. You'll be required to manually make the full payment for the specific billing period within a designated deadline mentioned on the invoice.
Subscription Fees: By subscribing to Growflyer's services, you agree to pay the specified fees for the chosen subscription plan.
Refund Policy: Users have the option to apply for a refund within three (3) days of their initial purchase, subject to the following conditions:
- Refund requests must be made within three (3) days of the purchase date.
- The refund will cover the amount paid for the subscription plan only; any additional fees or charges incurred during the transaction will not be refunded.
- After the three-day period expires, refund requests will not be processed.
Refund Procedure: To request a refund, please contact our support team at support@growflyer.com and provide the necessary details for processing your refund.
Growflyer reserves the right to modify the Subscription fees for the Subscriptions at its sole discretion and at any time. Any changes to Subscription fees will be effective at the end of the ongoing Billing Cycle.
We will provide you with reasonable prior notice of any changes in Subscription fees, allowing you the opportunity to terminate your Subscription before the revised fees take effect.
Your continued use of the Service after the revised Subscription fee comes into effect implies your agreement to pay the modified Subscription fee amount.
Ownership: Growflyer and/or its licensors retain all intellectual property rights related to the services provided. Users are granted a limited, non-exclusive, and non-transferable license to use the services in accordance with these terms and conditions.
Restrictions: Users must not reproduce, modify, distribute, or create derivative works based on our services without explicit written permission from Growflyer.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
Our Service may feature links to third-party websites or services that are independent and not operated by us.
We have no control over the content, privacy policies, or practices of these third-party websites or services. We do not assume any responsibility or liability for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through these external websites or services.
We strongly recommend reviewing the terms and conditions and privacy policies of any third-party websites or services that you access through our Service. Your interactions with these websites or services are solely between you and the third party, and any terms, conditions, warranties, or representations associated with such dealings are the responsibility of the respective third party
Disclaimer: Growflyer shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use our services.
Service Interruptions:We do not guarantee uninterrupted, error-free, or secure access to our services and reserve the right to modify or discontinue the services at any time without notice.
Growflyer reserves the right to modify these terms and conditions at any time. By continuing to use our services after any revisions become effective, you agree to be bound by the updated terms and conditions.
These terms and conditions shall be governed by and construed in accordance with the laws of India, and any disputes will be subject to the exclusive jurisdiction of the courts in that jurisdiction.
By using Growflyer's services, you acknowledge that you have read, understood, and agreed to these terms and conditions.
